NEPA Case Law Update

This webinar is part of the June 2016 two-part webinar series that will provide a National Environmental Policy Act (NEPA) Case Law Update and Legislative/Policy Update for those of you who were not able to attend the sessions at the National Conference in Chicago in April.

 

This webinar will cover the cases in reviewed in a recent paper, Recent NEPA Cases (from 2015), co-authored by Ms. Lucinda Low Swartz, Esq., environmental consultant and P.E. Hudson of the Department of the Navy, Office of General Counsel. After a brief overview by  Ms. Swartz, Ms. Hudson, and Dr. Michael D. Smith of ENERCON will discuss the key National Environmental Policy Act (NEPA) federal appellate court decisions issued in 2015. In 2015, the U.S. Courts of Appeal issued 14 decisions involving implementation of the NEPA by federal agencies, including four cases that involve challenges to the cumulative effects analyses undertaken by the federal Lead Agency. The 14 cases involved 11 different departments and agencies. Overall, the federal agencies prevailed in 11 of the 14 cases (79 percent). Opinions will be analyzed for their implications and relevance to NEPA practitioners, with an emphasis on key lessons to be learned for improving NEPA practice.

JUNE 8, 2016 - NEPA LEGISLATIVE/POLICY UPDATE

 

This webinar will provide a review of recently approved and pending National Environmental Policy Act (NEPA) policy on programmatic (broad scale) environmental assessments (EAs) and environmental impact statements (EISes). The implications of the recent enactment of Fixing America’s Surface Transportation Act (FAST Act) for transportation project undergoing NEPA review or state-level environmental reviews will be addressed. The speakers will be Ted Boling of the Council on Environmental Quality and Fred Wagner of Beveridge & Diamond.
