The National Association of Environmental Professionals will present a two-part webinar on the National Environmental Policy Act (NEPA) Policy and Case Law Update for those who were not able to attend the sessions at the National Conference in Honolulu in April, 2015.

May 20, 2015 – NEPA POLICY UPDATE
This webinar will provide a review of recently approved and pending NEPA Policy on programmatic – broad scale – environmental assessments (EA) and environmental impact statements (EIS), and the revised draft guidance on the analysis of greenhouse gas emissions and climate change under NEPA. In December 2014, the Council on Environmental Quality published Final Guidance for Effective Use of Programmatic NEPA Reviews and published the Revised Draft Guidance on Integrating Analysis of Greenhouse Gases and Climate Change into environmental documents prepared pursuant to NEPA for a public review and comment. The public review and comment period on the revised draft guidance ended on March 25, 2015 (https://www.whitehouse.gov/administration/eop/ceq/initiatives/nepa/ghg-guidance ). Mr. Horst Greczmiel, CEQ’s Associate Director for NEPA Oversight, will provide an update on other recently released guidance documents as well as other CEQ initiatives. He will also discuss other recent developments that impact NEPA practice from the Administration and Congress. Mr. Ron Bass, a Senior Consultant with ICF International who provides strategic advice on NEPA implementation and conducts peer reviews of environmental documents will provide guidance on how to integrate the recent guidance into environmental review documents prepared pursuant to NEPA.

May 27, 2015 – NEPA CASE LAW UPDATE
This webinar, presented by P.E. Hudson (Pam Ellen Hudson), Department of the Navy, Office of General Counsel, and Dr. Michael D. Smith of AECOM, will provide an overview of the paper authored by Lucinda Low Swartz and Ms. Hudson discussing the key NEPA federal appellate court decisions issued in 2014. In 2014, the U.S. Courts of Appeal issued 22 substantive decisions involving implementation of NEPA by federal agencies. The 22 cases involved 11 different departments and agencies, and covered a variety of issues including purpose and need, alternatives, supplementation requirements, cumulative impacts, and public involvement. The federal agencies prevailed in 19.5 of the 22 cases (89 percent). Opinions will be analyzed for their implications and relevance to NEPA practitioners, with an emphasis on key lessons to be learned for improving NEPA practice.
